Terms & Conditions
 

1.      CONTRACT
The Contract of Hire shall be between the Hirer and David Judd and subject
to the Conditions of Hire.

2. PAYMENT & BOOKING
A provisional booking can be accepted by telephone or email but must be
confirmed within 7 days by completion of the online confirmation for or printed
copy of the booking form and the required deposit. Provisional reservations will
be cancelled after 7 days without further reference. All parts of the confirmation
form must be completed. No more than the number of persons shown on the
website and included on the confirmation form may occupy the property, in order
to comply with legislation. The name and address of all adults aged 16 years and
over must be provided.
For bookings made more than 8 weeks before the start date, a deposit
of 30% of the booking cost is required. The balance of payment must be made 6 weeks
prior to the booking. An electronic invoice for the balance will be sent out and the
booking is deemed cancelled if the balance is not paid by a specific date. For
bookings made less than 8 weeks before the commencement of the rental the
total amount is required. In order to minimise administration overheads, payment
is preferred using direct online bank payments or BACS. Any cheques must be made
payable to David Judd and the booking reference number quoted on the
reverse of the cheque.  Bookings will not be confirmed until payments have fully
cleared.

3. PERIOD OF HIRE
Unless stated your accommodation will be ready for you after 3pm on arrival day and you must
vacate by 11am on departure day. The apartment is unlikely to suit a student let.

4. CARE OF THE PROPERTY
The accommodation must be left in a clean and tidy condition by 11am on departure
day. Any breakages and/or damage must be reported immediately. You may be
required to pay for breakages and/or damage depending on the circumstances that
caused the breakage/damage. David Judd reserves the right to invoice you for
additional sums where these cannot be recovered via an insurance claim.

5. PETS
Under no circumstances will pets of any kind be permitted in the accommodation.
This includes pets belonging to the Hirer and/or pets belonging to guests of the Hirer.
Breach of this condition may result in costs for specialist cleaning being levied.

6. SMOKING
The accommodation has been designated as a "no smoking" area. Under no
circumstances should smoking be permitted within the boundary of the property.
This includes internal corridors, lobby area. As with all other clauses, customers who
do not abide by the terms and conditions may be required to vacate the property
and forfeit the remainder of the booking without refund. In addition, they may be
required to pay cleaning charges for curtains, linens etc.

7. RIGHT OF ENTRY
The property owner or his representative shall be allowed the right of entry at all
reasonable times for inspection, repair or maintenance purposes.

8. BOOKING CANCELLATION AND CURTAILMENT INSURANCE
Cancellation: Your booking is a legally binding contract, and like all contracts you
should protect yourself in case things go wrong. That's why we recommend that all
our bookings be protected by holiday cancellation and curtailment insurance. We
regret that cancellations for whatever reason will be chargeable. You must make
your own arrangements for your insurance and you may wish to discuss this with an
insurance intermediary who is authorised and regulated by the Financial Services
Authority. David Judd is not authorised and regulated by the Financial Services
Authority and we are not therefore permitted to make any recommendations or
provide you with advise about any particular insurance product.

9. CANCELLATION (other reasons)
In the event of the Hirer wishing to cancel the arrangements prior to the
commencement of the letting and for the reasons not covered by your cancellation
policy, and upon notifying the office in writing, we shall endeavour to re-let the
property for the period concerned or for such part thereof as may prove possible.
If such letting can be arranged, the Balance, if already paid, will be refunded less
any deposit.


10. AVAILABILITY
The Hiring Contract is made on the understanding that the property and its facilities
as published will be available for the dates stated. In the unlikely event that the
property is not available through events arising out of the control of David Judd

2.       then David Judd may be forced to cancel the booking. The Hirer
will be advised of any such circumstances as early as possible, and David Judd
will refund all the monies paid in full - But the Hirer will have no further claims against
David Judd.

11. LINEN
Bed linen is supplied for the accommodation. This includes: a double-size quilt, a
double-size duvet cover, four pillows and four pillow slips for the double bed. Each
guest is provided with a hand towel and a bath towel. The kitchen is provided with
a supply of clean tea-towels.

12. INTERNET
Access to the internet  and broadband services via wifi is available with normal and
 reasonable usage.

13. COMPLAINTS
In the unlikely event of any complaint you should contact David Judd at the
earliest opportunity who will attempt to resolve the problem for you. It has to be
stressed that we cannot consider complaints reported after you return home from
your stay, when the Hirer has denied David Judd the opportunity of investigating
the complaint and endeavour to put matters right during the stay.

14. BROCHURE (online)
David Judd takes every care to ensure the accuracy of property descriptions.
All information is given in good faith and believed correct at the time of going to press,
but David Judd cannot be held responsible for any errors, or the results of such
errors. Further, David Judd cannot accept liability for happenings outside its
reasonable control, such as breakdown of domestic appliances, plumbing, wiring,
sudden temporary invasion of pests, damage resulting from exceptional weather
conditions.

15. LIABILITY
David Judd’s liability shall not exceed the amount actually paid as rental by the Hirer
for the accommodation rented to him/her from the company. It is an express condition
of the booking that Leladene Holdings cannot be held responsible for any accident,
loss or damage which may be sustained by any Hirer, member of his party, or visitor, or
their property, however caused.

16. PRICE CHANGES
David Judd reserves the right to amend prices quoted in the brochure (online),
due to errors and/or omissions.

17. SHORT BREAKS AND LONG LETS
Charges for long lets may vary from short breaks and will be agreed on an individual
basis with the Hirer and will be confirmed at the time of booking. The charges levied
will depend, amongst other things, on the frequency of cleaning and linen change
required by the Hirer.

18. DATA PROTECTION
David Judd will retain personal data in compliance with the Data Protection
Act 1998. Personal data is only retained for marketing and accounting/financial
purposes and will not be transferred to any other company without the express
permission of the data subject.

GENERAL ACCOMMODATION INFORMATION
The accommodation contains sufficient furnishings and equipment for a self-catered
stay for the number of guests advertised. David Judd aims for extremely high
standards and to this end, equipment provided is of a high quality. We kindly ask
that you respect the accommodation and its contents so that it can be enjoyed by
other guests.
We understand that from time to time, accidental breakages occur and equipment
fails. We shall make every effort to replace and/or repair such items as rapidly as
possible with items of the same or equivalent standard. The apartment is located in a
residential area occupied by other families. We ask that you show respect to the other
local residents. In particular, you are required under this contract not to allow the
radio, television or general noise to cause disruption or an annoyance. Please keep
noise to a minimum between 11pm and 8am.
